1. Acceptance of these Terms

By creating an account, connecting Instagram, sending content to @goplacesapp, submitting a link, or otherwise using the Service, you agree to these Terms and acknowledge the Places Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for an organization, you represent that you are authorized to accept these Terms for that organization.

2. Eligibility

You must be at least 16 years old to use Places. If you are below the age of legal majority where you live, you confirm that a parent or legal guardian permits your use. You must not use the Service if applicable law prohibits you from doing so.

3. The Service

Places helps users organize locations discovered through social media. A user may send a supported public Instagram Reel, post, or carousel to the Places Instagram account or paste a supported link into the app. Places may identify a location, categorize and describe it, and save it with the source link on the user's private map.

The private-alpha Service is experimental and may have incomplete features, limited availability, processing errors, provider outages, or incorrect place matches. Supported inputs, features, limits, and response times may change.

4. Accounts and Instagram connection

You must provide accurate information, protect your account and device, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account to the extent permitted by law.

Places may connect one Instagram identity to one Places account through an Instagram DM verification or secure claim process. Entering an Instagram username alone does not establish ownership. We may reject, suspend, or manually review a connection that appears fraudulent, duplicated, or unauthorized.

Never send us your Instagram, Meta, Apple, Google, or email password or authentication token.

5. Your submissions and permissions

You retain any rights you have in content and information you submit. By submitting a public Instagram link or other information to Places, you instruct us to process it for the Service and grant MNY GmbH a limited, non-exclusive, worldwide license to host, reproduce, transform, analyze, and display that submitted information only as reasonably necessary to provide, secure, support, and improve Places.

You represent that:

You are permitted to submit the link or information.
The submitted Instagram item is public and is not a Story, private-account item, or content obtained by bypassing access controls.
Your use does not violate law, these Terms, third-party rights, or applicable Instagram or Meta terms.
You will use retained thumbnails, links, captions, and place information only through the functions provided by Places and for lawful purposes.

Submitting a public link does not transfer ownership of the underlying Instagram content to you or to MNY GmbH. Instagram creators and other rightsholders retain their rights.

6. Acceptable use

You must not:

Use Places for unlawful, fraudulent, deceptive, harassing, or abusive activity.
Submit private content, stolen credentials, malicious links, or content you are not permitted to process.
Attempt to access another user's account, private map, submissions, or administrative systems.
Circumvent authentication, rate limits, security controls, provider restrictions, or technical safeguards.
Scrape, crawl, bulk-download, resell, or create a competing database from Places or its providers.
Reverse engineer, interfere with, overload, disrupt, or introduce malware into the Service, except where applicable law expressly permits limited reverse engineering.
Use the Service to infringe intellectual-property, privacy, publicity, or other rights.
Use output from Places to make high-impact decisions about another person.
Misrepresent an affiliation with MNY GmbH, Places, Meta, Instagram, or a place provider.

We may investigate suspected abuse and restrict or suspend access where reasonably necessary.

7. Instagram, Meta, maps, and other third-party services

Places depends on third-party services, including Meta and Instagram, authentication providers, app stores, hosting providers, mapping and place-data providers, AI providers, public-content metadata providers, and external websites.

Your use of those services may be governed by their separate terms and privacy policies. MNY GmbH does not control and is not responsible for third-party content, availability, changes, restrictions, deletion, or account decisions.

Places is not affiliated with, endorsed by, sponsored by, or operated by Meta or Instagram. Instagram links may stop working if a creator deletes content, changes privacy settings, disables embedding, or if Meta changes its products or APIs.

Places uses Google Maps Platform for map display and place resolution. Your use of Google Maps features is also subject to the Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps/ and the Google Privacy Policy at https://policies.google.com/privacy. Google Maps content may be refreshed, changed, or removed to comply with Google's terms, attribution requirements, and permitted storage periods.

8. Place information, AI, and accuracy

Place names, addresses, coordinates, categories, descriptions, thumbnails, opening information, websites, and automatic matches may come from third parties or automated systems and may be incomplete, outdated, or wrong.

Places may use AI for limited extraction, classification, confidence assessment, and descriptions. AI output is not guaranteed to be factual. Users can correct saved information or move an Instagram item to another place.

Always independently verify addresses, opening hours, accessibility, prices, reservations, entry requirements, weather, trail conditions, safety information, and travel restrictions. Places does not provide navigation, travel-agent, safety, medical, legal, financial, or emergency advice.

9. Privacy

Our Privacy Policy explains how we process personal data, including Meta and Instagram Platform Data. It forms part of these Terms and is available at https://getplacesapp.com/privacy.

Data deletion instructions are available at https://getplacesapp.com/data-deletion.

Saved places are private by default in the current version. Future sharing or collaboration features will require an intentional user action and may be governed by additional terms or settings.

Do not assume that a shared device, shared account, screenshot, external Instagram link, or future collaboration space is private. You are responsible for choosing what you share with other people.

11. Service communications

We may send operational messages necessary to provide the Service, including Instagram processing replies, authentication messages, security alerts, retention warnings, support responses, and important policy or service notices.

Marketing messages, if introduced, will be sent only as permitted by law and may be disabled using the method provided with the message.

12. Fees and future paid features

The private alpha may be provided without charge. We may later introduce subscriptions or paid features. We will disclose the price, billing period, renewal terms, taxes, and cancellation method before charging you. Paid features may be governed by additional terms and applicable app-store rules.

13. Intellectual property

Except for user submissions and third-party materials, MNY GmbH and its licensors own the Service, software, designs, branding, text, generated user interface, and related intellectual property. Subject to these Terms, MNY GmbH gives you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

"Places" is a working product name. No license to use MNY GmbH or Places branding is granted except as necessary to identify the Service.

14. Feedback

If you provide feedback or suggestions, you permit MNY GmbH to use them without restriction or payment, provided we do not publicly identify you without permission.

15. Suspension and termination

You may stop using the Service at any time. You may delete individual submissions or places using available controls and may request account deletion using the Data Deletion Instructions.

We may suspend or terminate access if we reasonably believe you violated these Terms, created security or legal risk, abused providers, or if continued operation is no longer commercially or technically practical. Where appropriate, we will provide notice and an opportunity to address the issue.

Termination does not remove provisions that by their nature should continue, including intellectual-property, liability, dispute, and lawful record-retention provisions.

16. Changes and availability

We may modify, pause, limit, or discontinue all or part of the Service. During the private alpha, we do not promise uninterrupted operation, a particular response time, support for every Instagram item, or permanent availability of any feature or provider.

We will take reasonable care not to lose saved user data, but you should not use Places as the sole record of information that is critical to safety, travel, or business.

17. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." MNY GmbH disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

18. Limitation of liability

To the maximum extent permitted by law, MNY GmbH is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, data, goodwill, travel opportunity, reservations, or business arising from use of or inability to use the Service.

MNY GmbH's aggregate liability arising out of the Service will not exceed the greater of CHF 100 or the amount you paid MNY GmbH for the Service during the twelve months before the event giving rise to the claim.

These limitations do not apply to liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence, death or personal injury caused by negligence where applicable, or mandatory consumer rights.

19. Indemnity

To the extent permitted by law, you agree to reimburse MNY GmbH for reasonable losses and third-party claims resulting from your unlawful use of the Service, your material violation of these Terms, or content you submitted without the required rights. This obligation does not apply to the extent a claim was caused by MNY GmbH.

20. Governing law and disputes

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

Subject to mandatory consumer law and any right a consumer has to bring proceedings in their country of residence, the courts with jurisdiction at the registered seat of MNY GmbH in the Canton of Zug, Switzerland, have exclusive jurisdiction.

Before filing a claim, please contact admin@getplacesapp.com so we can try to resolve the issue informally.

21. Changes to these Terms

We may update these Terms to reflect changes to the Service, providers, law, or security requirements. We will update the date above and give additional notice when a change materially affects users. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law; otherwise, we will request consent.
